The article examines four models of data governance emerging in the current platform society. While major attention is currently given to the dominant model of corporate platforms collecting and economically exploiting massive amounts of personal data, other actors, such as small businesses, public bodies and civic society, take also part in data governance. The article sheds light on four models emerging from the practices of these actors: data sharing pools, data cooperatives, public data trusts and personal data sovereignty. We propose (...) a social science-informed conceptualisation of data governance. Drawing from the notion of data infrastructure we identify the models as a function of the stakeholders’ roles, their interrelationships, articulations of value, and governance principles. Addressing the politics of data, we considered the actors’ competitive struggles for governing data. This conceptualisation brings to the forefront the power relations and multifaceted economic and social interactions within data governance models emerging in an environment mainly dominated by corporate actors. These models highlight that civic society and public bodies are key actors for democratising data governance and redistributing value produced through data. Through the discussion of the models, their underpinning principles and limitations, the article wishes to inform future investigations of socio-technical imaginaries for the governance of data, particularly now that the policy debate around data governance is very active in Europe. Internet of Things, Internet of Everything and Internet of People are concepts suggesting that objects, devices, and people will be increasingly interconnected through digital infrastructure that will generate a growing gathering of data. Parallel to this development is the celebration of the smart city and sharing city as urban policy visions that by relying heavily on new technologies bear the promise of efficient and thriving cities. Law and policy scholarship have either focused on questions related to privacy, discrimination, security, or (...) issues related to the production and use of big data, digital public services. Little or no attention has been paid to the disruptive impact of technological development on urban governance and city inhabitants’ rights of equal access, participation, management and even ownership, in order to understand whether and how technology can also enhance the protection of human rights and social justice in the city. This Article proposes complementing the technological and digital infrastructure with a legal and governance infrastructure, the Internet of Humans, by construing and injecting in the policy framework of the city the principle of Tech Justice. Building on a literature review and from an analysis of selected case studies, this Article stresses the dichotomy existing between the market-based and the society-based applications of technology, the first likely to increase the digital divide and the challenges to human rights in the city, the latter bearing the promise to promote equal access to technology in the city. The main argument advanced by this Article is that the principle of Tech Justice if embedded as an empirical dimension of smart city and sharing city policies can steer their developments in the direction of a more just and democratic city. Citizen-gathered evidence (CGE) gathered by individuals organized in collectives have the potential to demonstrate environmental and social wrongdoings in court. We identify (collective) agency and resistance in how individuals and communities that have been exposed to socio-environmental stressors turn to gather CGE. We explore the modes through which people gather scientific data, produce CGE, alert authorities to environmental harm, and the methods by which data can be shared with communities, beginning with the case studies of civic environmental monitoring addressing coal (...) ash pollution in North Carolina. We analyze the case studies through a theoretical lens built on (1) the theory of civic monitoring “as resistance;” (2) the argument that CGE can embody “collective intelligence;” and (3) the concept of “crowd science” through a decentralized yet coordinated network. In the first part of the article, we introduce the case studies. Then, we illustrate our theoretical frame as applied to the analysis of the cases. We discuss the cases and in particular the CGE at issue through the prism of the frame. We demonstrate how CGE can be valuable not only for civil society and civic organizations, but also for competent authorities. In our conclusion, we identify critical junctures of our case studies, such as that of “knowledge crowdsourcing” to demand justice that triggers the government to take action and the existence of a “coordinated” yet decentralized crowd to capture the full extension of the problem. In the present paper, we will attempt to gain hints regarding the nature of tactile awareness in humans. At first, we will review some recent literature showing that an actual tactile experience can emerge in absence of any tactile stimulus (e.g., tactile hallucinations, tactile illusions). According to the current model of tactile awareness, we will subsequently argue that such (false) tactile perceptions are subserved by the same anatomo-functional mechanisms known to underpin actual perception. On these bases, we will discuss the (...) hypothesis that tactile awareness is strongly linked to expected rather than actual stimuli. Indeed, this hypothesis is in line with the notion that the human brain has a strong predictive, rather than reactive, nature. (shrink)

The body may be the object we know the best. It is the only object from which we constantly receive a flow of information through sight and touch; and it is the only object we can experience from the inside, through our proprioceptive, vestibular, and visceral senses. Yet there have been very few books that have attempted to consolidate our understanding of the body as it figures in our experience and self-awareness. This volume offers an interdisciplinary and comprehensive treatment of (...) bodily self-awareness, the first book to do so since the landmark 1995 collection The Body and the Self, edited by José Bermúdez, Naomi Eilan, and Anthony Marcel. Intuitively, we often see absences. For example, if someone steals your laptop at a café, you may see its absence from your table. However, absence perception presents a paradox. On prevailing models of perception, we see only present objects and scenes (Marr, Gibson, Dretske). So, we cannot literally see something that is not present. This suggests that we never literally perceive absences; instead, we come to believe that something is absent cognitively on the basis of what we perceive. But this (...) cognitive explanation does not do justice to the phenomenology. Many experiences of absence possess immediate, perceptual qualities. One may further argue that the ability to detect certain absences confers strong adaptive advantage and therefore must be as primitive and fundamental to humans as seeing positive things. I argue that we can literally see absences; in addition to representing objects, perception represents absences of objects. I present a model of seeing absence based on visual expectations and a visual matching process. The phenomenon of seeing absence can thus serve as an adequacy-test for a theory of perceptual content. If experiences of absence are possible, then we have another reason (following Siegel) to reject the view that perceptual content is restricted to colors and shapes. Furthermore, if the proposed account is correct, then we have grounds for dissociating seeing absence from other imagery-based phenomena termed “perceptual presence-in-absence” (Noë, Macpherson). Superstition and confabulation are extremely pervasive in our cognitive lives. Whilst both these phenomena are widely discussed in the recent psychological literature, however, the relationship between them has not been the object of much explicit attention. In this paper, I argue that this relationship is actually very close, and deserves indepth consideration. I argue that superstitious and confabulatory attitudes share several key features and are rooted in the same psychological mechanisms. Moreover, some of the key features that superstitious and confabulatory (...) attitudes share reveal such attitudes to be non-doxastic in nature, with important implications for our assessment of their epistemic rationality. Many instances of what we call superstitious and confabulatory ‘beliefs’ are not, in fact, beliefs; hence, entertaining them may be less irrational than it prima facie seems to be. (shrink)

Imagination and belief are obviously different. Imagining that you have won the lottery is not quite the same as believing that you have won. But what is the difference? According to a standard view in the contemporary debate, they differ in two key functional respects. First, with respect to the cognitive inputs to which they respond: imaginings do not respond to real-world evidence as beliefs do. Second, with respect to the behavioural outputs that they produce: imaginings do not motivate us (...) to act as beliefs do. I argue that this view is mistaken in one important respect. The distinction between imagination and belief does lie at the functional level; but the relevant functional difference does not concern behavioural outputs – since, in spite of appearances, imaginings and beliefs motivate us to act in the same ways. To see the difference, we need to focus on the inputs side – and, relatedly, on the sorts of inferential relations that imaginings and beliefs bear to each other. I show that this view does not have the absurd consequences that it may prima facie seem to have; on the contrary, it has important implications for our understanding of how the mind works. (shrink)

The 1994 US spectrum auction is now a paradigmatic case of the successful use of microeconomic theory for policy-making. We use a detailed analysis of it to review standard accounts in philosophy of science of how idealized models are connected to messy reality. We show that in order to understand what made the design of the spectrum auction successful, a new such account is required, and we present it here. Of especial interest is the light this sheds on the issue (...) of progress in economics. In particular, it enables us to get clear on exactly what has been progressing, and on exactly what theory has – and has not – contributed to that. This in turn has important implications for just what it is about economic theory that we should value. (shrink)

In Valuing Health, Dan Hausman argues that well-being is not measurable, at least not in the way that science and policy would require. His argument depends on a demanding conception of well-being and on a pessimistic verdict upon the existing measures of subjective well-being. Neither of these reasons, I argue, warrant as much skepticism as Hausman professes.

Epistemic injustice is a kind of injustice that arises when one’s capacity as an epistemic subject is wrongfully denied. In recent years it has been argued that psychiatric patients are often harmed in their capacity as knowers and suffer from various forms of epistemic injustice that they encounter in psychiatric services. Acknowledging that epistemic injustice is a multifaceted problem in psychiatry calls for an adequate response. In this paper I argue that, given that psychiatric patients deserve epistemic respect and have (...) a certain epistemic privilege, healthcare professionals have a pro tanto epistemic duty to attend to and/or solicit reports of patients’ first-person experiences in order to prevent epistemic losses. I discuss the nature and scope of this epistemic duty and point to one interesting consequence. In order to prevent epistemic losses, healthcare professionals may need to provide some patients with resources and tools for expressing their experiences and first-person knowledge, such as those that have been developed within the phenomenological approach. I discuss the risk of secondary testimonial and hermeneutical injustice that the practice of relying on such external tools might pose and survey some ways to mitigate it. (shrink)

This paper considers the relationship between institutions and the “sexual imaginary,” understood as the set of affective and imaginative resources that produce certain forms of sexual subjectivity. Drawing on the work of Cornelius Castoriadis and Moira Gatens, I argue that institutions play an important role in shaping sexual imaginaries. Historically, institutions have been sites in which unjust sexual norms have been reinforced and legitimized. I analyse the growing trend of consent education at Australian universities to explore how institutions may also (...) represent potential sites for contesting and reimagining these norms. Feminist critiques of consent suggest that consent education may in fact reproduce a narrow and conservative vision of sexuality, one that aligns with the neoliberal politics of the contemporary university. This paper contributes to these critiques by exploring how both the neoliberal university and consent theory are premised on a distorted vision of the subject as a rational, disembodied being. I argue that transforming dominant sexual imaginaries requires recognizing and interrogating both how desire permeates institutional spaces and the role of desire in ethical sexual relations. The Stoic theory of knowledge was founded by Zeno on a perceptual and crudely materialistic base, but subsequently developed into an elaborate theory involving λεκτ which has proved difficult to reconstruct. The evolution of the school, influenced not only by internal differences but also by interaction with the Platonic Academy, certainly contributed to this development. Hence any adequate reconstruction of the Stoic theory of knowledge must take account of the differences among the positions of the different representatives of the school (...) with respect to the criticism put foward by the Academics. I propose here to clarify Zeno's position, showing how Arcesilaus' criticism helped to expose certain lacunae and thus to bring about changes in doctrine on the part both of Zeno himself and of his immediate successors. Wie verändern sich Mensch und Körper durch Technik? Und welches Menschenverständnis vertritt der Transhumanismus? Anna Puzio befasst sich in der ersten philosophischen Studie zur Anthropologie des Transhumanismus mit führenden Personen des Feldes, u. a. mit Nick Bostrom, David Pearce und Natasha Vita-More. Neben Körperoptimierung und Medizintechnologien beleuchtet sie auch Alltagstechnologien wie Wearables. Dabei entwickelt sie einen neuen Ansatz zur Technikanthropologie und ein neues inklusives Menschen- und Körperverständnis im Anschluss an Donna Haraway und den Kritischen Posthumanismus im amerikanischen Raum.

Within bioethics, Kant’s conception of autonomy is often portrayed as excessively rationalistic, abstract, and individualistic, and, therefore, far removed from the reality of patients’ needs. Drawing on recent contributions in Kantian philosophy, we argue that specific features of Kantian autonomy remain relevant for medical ethics and for patient experience. We use contemporary end-of-life illness narratives—a resource that has not been analyzed with respect to autonomy—and show how they illustrate important Kantian themes, namely, the duty to know oneself, the interest in (...) elaborating universalizable principles, and the emphasis on ideals as points of orientation that guide behavior without ever being fully realized. As Kant does, the patient-authors discussed here perceive the end of life as a moment to reflect on the constitutive principles which have governed that life, thereby offering a privileged moment to pursue self-knowledge. We argue that bioethical conceptions of autonomy stand to gain if they revise their conception of Kantian moral philosophy as too formal, abstract, and detached from emotions and personal relationships to be helpfully applied. Scholarship on gender and the European Union has consistently pointed out that EU gender equality policies have always been embedded in the logic of the market and that the economic framing has had negative impacts on the content and concepts of these policies. This article provides novel insights into this discussion by combining a discursive approach focused on framings with insights of feminist economists and examining how the relationship between gender equality and the economy has been conceptualized in EU policy (...) documents from the 1980s up until the present day. The article identifies the key actors and processes behind the escalation of economic arguments for gender equality and makes visible the economic assumptions that underpin EU gender equality policy. It argues that in recent years the European institutions have intentionally developed and propagated a market-oriented gender equality discourse, the economic case for gender equality, which highlights the macroeconomic benefits of gender equality. The economic case reaffirms the gender-biased assumptions of neoclassical economic theory and legitimizes the EU’s current economic priorities and policies, many of which are detrimental to gender equality. The European Commission represents the argument that gender equality contributes to economic growth as an innovative way to promote gender equality. However, the economic case represents a risk for gender equality advocates, because it may tame the emerging feminist criticism of the EU’s economic policies and governance. (shrink)

The much-lamented anthropocentrism of human rights is misleading. Human rights anthropocentrism is radically attenuated and reflects persistent patterns of intra- and interspecies injustice and binary subject–object relations inapt for twenty-first-century crises and posthuman complexities. This article explores the possibility of reimagining the “human” of human rights in the light of anti- and post-Cartesian analyses drawing—in particular—upon Merleau-Ponty and on new materialism. This article also seeks to reimagine human rights themselves as responsibilized, injustice-sensitive claim concepts emerging in the “midst of” lively (...) materialities and the uneven global dynamics of twenty-first-century predicaments. When you hear a person speaking in a familiar language you perceive the speech sounds uttered and the voice that produces them. How are speech sounds and voice related in a typical auditory experience of hearing speech in a particular voice? And how to conceive of the objects of such experiences? I propose a conception of auditory objects of speech perception as temporally structured mereologically complex individuals. A common experience is that speech sounds and the voice that produces them appear (...) united. I argue that the metaphysical underpinnings of the experienced unity of speech sounds and voices can be explained in terms of the mereological view on sounds and their sources. I also propose a psychological explanation of how we form and individuate the auditory objects of experiences of listening to speech in a particular voice. Voice characteristics enable determining the identity of auditory objects of speech sound perception by making some features of the speech signal stable and predictable. (shrink)

Here’s a plausible thought: we should make a promise only if we rationally believe that we will follow through. But if that’s right, and if it’s rational to believe only what our evidence supports, then it seems that we shouldn’t make promises to do things our evidence suggests that there’s a significant chance we don’t do – things that many others, or we ourselves, have set out and failed to do. Think: promises to stay faithful or to be on time (...) or to quit smoking. But surely that can’t be right! After all, these are some of our most important promises. This leaves us with a puzzle: either accept that sometimes it’s ok to promise against the evidence or accept that we shouldn’t be making many of our most important promises. This paper develops a response to this puzzle. Promising against the evidence turns out to be morally problematic across the board. But, upon closer inspection, it seems our evidence often does support the belief that we will do something that many others, or we ourselves, have set out and failed to do. When it does, promising is permissible. When it doesn’t, promising is not the right thing to do. (shrink)

Recent editions of diagnostic manuals in psychiatry have focused on providing quick and efficient operationalized criteria. Notwithstanding the genuine value of these classifications, many psychiatrists have argued that the operationalization approach does not sufficiently accommodate the rich and complex domain of patients’ experiences that is crucial for clinical reasoning in psychiatry. How can we increase the role of phenomenology in the process of diagnostic reasoning in psychiatry? I argue that this could be done by adopting a clinical staging approach in (...) diagnostic reasoning in psychiatry. The approach has the resources to include the progressive nature of patients’ experiences to a much greater degree than is currently practiced. It can address the recent plea for increasing the role of phenomenology in psychiatric diagnosis by offering a model for clinical reasoning that goes beyond the operationalized, static criteria of diagnostic manuals, without depriving us of their benefits. In March 1986, a public symposium took place in Heidelberg about the “unresolved potential dangers of genetic engineering”. The event was organized by institutions affiliated with the environmental movement. Choosing this symposium as an example, the article shows how the public appearance of scientists can be understood as a form of political activism. The article shows how specialists from fields as diverse as biology, chemistry, physics, law and political sciences tried to place political messages by putting themselves in the limelight (...) as independent scientists. I argue that the symposium was both: a place of science communication intertwined with political agitation that, as should be noted, happened in a time when the West German government was working on the legislation of genetic engineering, legitimated by relying on independent expertise. It can be concluded that the discourse of scientific independence became a strategic tool in the controversial debate about the uses and dangers of genetic engineering. Thus, it draws attention to a dimension of political-scientific activity which cannot be fully grasped by the concept of ‘the expert’ that is established in the history of science. (shrink)

Language understanding comes with a particular kind of phenomenology. It is often observed that when listening to utterances in a familiar language, competent language users can have experiences of understanding the meanings of these utterances. The nature of such experiences is a much debated topic. In this paper, I develop a new proposal according to which experiences of understanding are a particular kind of epistemic feelings of fluency that result from evaluative monitoring processes. The perceptual experience that accompanies linguistic comprehension (...) results from the deployment of early stage auditory processes of speech perception that lead to the recognition of words. Is open-mindedness a moral virtue? Surprisingly, this question has not received much attention from philosophers. In this paper, we fill this lacuna by arguing that there are good grounds for thinking that it is. In particular, we show that the extant account of open-mindedness as a moral virtue faces an objection that appears to show that exercising the character trait may not be virtuous. To offset this objection, we argue that a much stronger argument can be made for the case (...) that open-mindedness is a moral virtue by appealing to the notion of moral understanding. Specifically, we provide a new rationale as to why we should exercise open-mindedness and offer several arguments to allay the concern that doing so can at times cause us to be in an epistemically and morally weaker position.
